This document (as well as other documents mentioned herein) regulates the conditions governing the use of this Website (www.tubosdebaja.com) and the purchase or acquisition of products and/or services on the same (hereinafter, Conditions).

For the purposes of these Conditions, it is understood that the activity carried out through the Website comprises:

The marketing of flexible hoses for various uses with fluids and gases.

In addition to reading these Conditions, before accessing, browsing and/or using this website, the User must have read the Legal Notice and the General Conditions of Use, including the cookies policy, and the privacy and data protection policy of Tubosdebaja. By using this Website or by making and/or requesting the acquisition of a product and/or service through it, the User consents to be bound by these Conditions and by all the aforementioned; therefore, if you do not agree with all of them, you should not use this Website.

Furthermore, please be informed that these Conditions may be modified. The User is responsible for consulting them each time they access, browse and/or use the Website, as those in force at the time the acquisition of products and/or services is requested shall be applicable.

For any questions the User may have regarding the Conditions, they may contact the owner using the contact details provided above or, where appropriate, using the contact form.

  1. THE USER

Accessing, browsing and using the Website confers the status of user (hereinafter referred to, indistinctly, individually as User or collectively as Users); therefore, from the moment browsing the Website begins, all the Conditions established herein are accepted, as well as their subsequent modifications, without prejudice to the application of the corresponding mandatory legal regulations as the case may be.

The User assumes responsibility for the correct use of the Website. This responsibility shall extend to:

  • Using this Website solely for making legally valid enquiries and purchases or acquisitions.
  • Not making any false or fraudulent purchases. If such a purchase could reasonably be considered to have been made, it could be cancelled and the relevant authorities would be informed.
  • Providing truthful and lawful contact details, for example, email address, postal address and/or other data (see Legal Notice and General Conditions of Use).

The User declares to be over 18 years of age and to have the legal capacity to enter into contracts through this Website.

The User may formalise, at their choice, the contract for the sale of the desired products and/or services in any of the languages in which these Conditions are available on this Website.

  1. PURCHASE OR ACQUISITION PROCESS

Duly registered Users may purchase on the Website by the established means and forms. They must follow the online purchase and/or acquisition procedure of www.tubosdebaja.com, during which several products and/or services can be selected and added to the basket, cart or final purchase space and, finally, click on: «Finish purchase».

Likewise, the User must fill in and/or check the information requested at each step, although, during the purchase process, before making the payment, the purchase data can be modified.

Subsequently, the User will receive an email confirming that their order or request for purchase and/or provision of service has been received, i.e., the order confirmation. And, where appropriate, they will also be informed by email when their purchase is being dispatched. Where applicable, this information could also be made available to the User through their personal connection space on the Website.

Once the purchase procedure has concluded, the User consents to the Website generating an electronic invoice which will be sent to the User via email and, where appropriate, through their personal connection space on the Website. Likewise, the User may, if they so wish, obtain a copy of their invoice on paper by requesting it from VILATRENZ 2000, S.L. using the contact spaces on the Website or through the contact details provided above.

The User acknowledges being aware, at the time of purchase, of certain particular conditions of sale concerning the product and/or service in question and which are shown alongside the presentation or, where appropriate, the image of it on its Website page, indicating, by way of example, but not limited to, and according to each case: name, price, components, weight, quantity, colour, product details, or characteristics, the manner in which they will be carried out and/or the cost of the services; and acknowledges that placing the purchase or acquisition order materialises the full and complete acceptance of the particular conditions of sale applicable to each case.

Communications, purchase orders and payments involved during transactions carried out on the Website may be archived and kept in the computerised records of Tubosdebaja in order to constitute a means of proof of transactions, in any case, respecting reasonable security conditions and the current laws and regulations applicable in this regard, and particularly in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR) and Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights, and the rights assisting Users pursuant to the privacy policy of this Website.

The electronic invoicing system used complies with the requirements of integrity, conservation and legibility (Verifactu System) in force in 2026.

  1. AVAILABILITY

All purchase orders received through the Website are subject to the availability of the products and/or that no circumstance or cause of force majeure (clause nine of these Conditions) affects the supply thereof and/or the provision of the services. Should difficulties arise regarding the supply of products or should products no longer be in stock, we undertake to contact the User and refund any amount that may have been paid. This shall equally apply in cases where the provision of a service becomes unfeasible.

  1. PRICES AND PAYMENT

The prices of the products shown on the Website may vary depending on the quantity purchased. Three differentiated price groups are established based on the purchase volume, which will be automatically applied in the shopping basket upon reaching the quantity thresholds established for each product. Prices include the current Value Added Tax (VAT), unless a different matter applies by legal requirement. The final price will be calculated automatically before formalising the payment.

Under no circumstances will the Website automatically add additional costs to the price of a product or service, but only those that the User has voluntarily and freely selected and chosen.

Prices may change at any time, but potential changes will not affect orders or purchases for which the User has already received an order confirmation.

The accepted means of payment will be: Credit or debit card and Bizum.

Tubosdebaja uses all means to ensure the confidentiality and security of the payment data transmitted by the User during transactions through the Website. As such, the Website uses an SSL (Secure Socket Layer) secure payment system.

Credit cards will be subject to checks and authorisations by the issuing bank; if said entity does not authorise the payment, we shall not be responsible for any delay or non-delivery and will not be able to formalise any contract with the User.

Once the purchase order is received from the User through the Website, a pre-authorisation will be made on the corresponding card to ensure there are sufficient funds to complete the transaction. The charge to the card will be made at the moment the shipping confirmation and/or confirmation of the service provided is sent to the User in the established form and, where appropriate, place.

In any case, by clicking «Finalizar compra», the User confirms that the payment method used is theirs.

  1. DELIVERY AREAS AND SHIPPING COSTS (CARRIAGE)

For the 2026 financial year, the following transport conditions are established. The amounts are applied automatically according to the destination, except for the detailed exceptions:

-Mainland Spain and Portugal: Flat rate of 6.80 €.

-Balearic Islands and European Union (Standard Destinations): Flat rate of 13.50 €. "Standard Destinations" are considered to be the mainland territories of EU member countries and the Balearic Islands.

-Exclusion of Special and Remote Territories: Those territories which, even belonging to European Union countries, present logistical, customs complexities or remoteness that do not justify said amount (such as Outermost Regions, overseas regions, difficult-to-access non-mainland islands or territories with special tax regimes) are expressly excluded from the flat rate of 13.50 € and from the automatic management of the website. For these destinations, as well as for the Canary Islands, Ceuta and Melilla, the User must request a personalised quote by email.

-Carriage Paid (Exceptions): Shipping costs will be free for orders destined for the Mainland and Europe (Standard Destinations only) whose net amount is equal to or greater than 130 €. This promotion shall not be applicable to the "Special and Remote Territories" mentioned above, which shall always be subject to a prior logistical quote, regardless of the purchase amount.

Revision and Force Majeure Clause

VILATRENZ 2000 S.L. reserves the right to modify these rates from the next financial year or immediately in the face of Force Majeure circumstances. Such circumstances include, by way of example but not limited to: energy crises seriously affecting the price of fuel, armed conflicts, transport strikes, pandemics or any other situation of geopolitical or economic instability involving a disproportionate increase in logistical network costs. In such cases, the User will be duly informed before the completion of any affected order.

Except for those cases in which there are unforeseen or extraordinary circumstances or, where appropriate, derived from the customisation of the products, the purchase order consisting of the products listed in each purchase confirmation will be delivered within the period indicated on the Website according to the shipping method selected by the User —usually within 24 to 72 hours for destinations in Mainland Spain and Portugal— and, in any case, within a maximum period of 30 calendar days from the date of the order confirmation.

If for any reason attributable to us, the delivery date cannot be met, we will contact the User to inform them of this circumstance and they may choose to proceed with the purchase by establishing a new delivery date or else cancel the order with a full refund of the price paid. In any case, home deliveries are made on working days.

If it is impossible to deliver the order due to the User's absence, the order may be returned to the warehouse. Nevertheless, the carrier would leave a notice explaining where the order is located and how to arrange for it to be delivered again.

If the User is not going to be at the delivery place in the agreed time slot, they must contact Tubosdebaja to arrange delivery on another day.

In the event that 30 days elapse since your order is available for delivery and it has not been delivered for causes not attributable to Tubosdebaja, it will be understood that the User wishes to withdraw from the contract and it shall be considered terminated. As a consequence of the termination of the contract, all payments received from the User will be returned, with the exception of additional costs resulting from the User's own choice of a delivery method other than the least expensive ordinary delivery method offered by the Website, without any undue delay and, in any case, within a maximum period of 14 calendar days from the date on which the contract is considered terminated.

However, the User must bear in mind that the transport derived from the termination may have an additional cost which may be passed on to them.

For the purposes of these Conditions, it shall be understood that delivery has occurred or that the order has been delivered at the moment in which the User or a third party indicated by the User acquires material possession of the products, which shall be evidenced by signing the receipt of the order at the agreed delivery address.

The risks that may derive from the products shall be borne by the User from the moment of delivery. The User acquires ownership of the products when full payment of all amounts due in relation to the purchase or acquisition made is received, including shipping costs, or else at the moment of delivery, if this takes place at a time later than the full receipt of the amount subject to payment by Tubosdebaja.

In accordance with the provisions of Law 37/1992, of 28 December, on Value Added Tax (VAT), purchase orders for delivery and/or provision shall be deemed to be located in the territory of application of Spanish VAT if the delivery address is in Spanish territory except for the Canary Islands, Ceuta and Melilla. The applicable VAT rate will be that legally in force at any given time depending on the specific item in question.

  1. TECHNICAL MEANS TO CORRECT ERRORS

The User is informed that should they detect that an error has occurred when entering data necessary to process their purchase request on the Website, they may modify the same by contacting Tubosdebaja through the contact spaces enabled on the Website, and, where appropriate, through those enabled to contact customer service, and/or using the contact details provided in the first clause (General Information). Likewise, this information could also be corrected by the User through their personal connection space on the Website.

In any case, the User, before clicking «Finalizar compra», has access to the space, basket, or cart where their purchase requests are recorded and can make modifications.

Similarly, the User is referred to consult the Legal Notice and General Conditions of Use and, specifically, the Privacy Policy for more information on how to exercise their right of rectification as established in Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR) and in Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights.

  1. RETURNS

In cases where the User acquires products on or through the owner's Website, they are assisted by a series of rights, as listed and described below:

Right of Withdrawal

The User, as a consumer and user, makes a purchase on the Website and, therefore, has the right to withdraw from said purchase within a period of 14 calendar days without the need for justification.

This withdrawal period will expire 14 calendar days from the day that the User or a third party authorised by them, other than the carrier, acquired material possession of the goods acquired on the Website of Tubosdebaja or in the event that the goods making up their order are delivered separately, 14 calendar days from the day that the User or a third party authorised by them, other than the carrier, acquired material possession of the last of those goods that made up the same purchase order, or in the case of a service contract, 14 calendar days from the day of the conclusion of the contract.

To exercise this right of withdrawal, the User must notify Tubosdebaja of their decision. They may do so, where appropriate, through the contact spaces enabled on the Website.

The User, regardless of the means they choose to communicate their decision, must express clearly and unequivocally that it is their intention to withdraw from the purchase contract. In any case, the User may use the model withdrawal form made available as an attached part of these Conditions; however, its use is not mandatory.

To meet the withdrawal deadline, it is sufficient for the communication expressing the unequivocal decision to withdraw to be sent before the corresponding period expires.

In the event of withdrawal, the User will be reimbursed for all payments received, including shipping costs (with the exception of additional costs chosen by the User for a shipping method other than the least expensive method offered on the Website) without any undue delay and, in any case, no later than 14 calendar days from the date on which the User's decision to withdraw is informed.

Tubosdebaja will reimburse the User using the same payment method used to perform the initial purchase transaction. This reimbursement will not generate any additional cost to the User. However, the reimbursement may be withheld until the products or items of the purchase have been received, or until the User presents proof of the return thereof, whichever condition is met first.

The User can return or send the products to VILATRENZ 2000, S.L. at: C/ Guix nº 11 (Pol. Masia Barreres) of 08800-VILANOVA I LA GELTRU.

And they must do so without any undue delay and, in any case, no later than within 14 calendar days from the date on which they were informed of the decision to withdraw.

The User acknowledges awareness that they must assume the direct cost of returning (transport, delivery) the goods, should any be incurred. Furthermore, they shall be responsible for the decrease in value of the products resulting from handling other than that necessary to establish the nature, characteristics and functioning of the goods.

Pursuant to Art. 103 of the Consumer Law, the right of withdrawal shall not be applicable to those products that have been made to the customer's specifications or clearly personalised, which includes hoses, tubes or braids cut to a specific length requested by the User.

In this same sense, the provision of a service that the User might contract on this Website is governed, as this same Law establishes that the Right of withdrawal will not assist Users when the service provision has been fully executed, or when it has begun, with the express consent of the consumer and user and with the acknowledgement on their part that they are aware that, once the contract has been fully executed by Tubosdebaja, they will have lost their right of withdrawal.

In any case, no refund will be made if the product has been used beyond the mere opening of the same, for products that are not in the same conditions in which they were delivered or that have suffered any damage after delivery.

Likewise, the products must be returned using or including all their original packaging, instructions and other documents that may accompany them, in addition to a copy of the purchase invoice.

Return of defective products or shipping error

This refers to all those cases in which the User considers that, at the moment of delivery, the product does not conform to what was stipulated in the contract or purchase order, and that, therefore, they must contact Tubosdebaja immediately and let them know of the existing non-conformity (defect/error) by the same means or using the contact details provided in the previous section (Right of Withdrawal).

The User will then be informed on how to proceed with the return of the products, and these, once returned, will be examined and the User will be informed, within a reasonable period, whether a refund or, where appropriate, a replacement of the same is appropriate.

The refund or replacement of the product will be made as soon as possible and, in any case, within 14 days following the date on which we send an email confirming that the refund or replacement of the non-conforming item is appropriate.

The amount paid for those products that are returned due to a defect, when it actually exists, will be reimbursed in full, including delivery costs and the costs that the User may have incurred to make the return. The reimbursement will be made by the same payment method that the User used to pay for the purchase.

In any case, the rights recognised in the legislation in force at any given time for the User, as a consumer and user, shall always be upheld.

Guarantees

The User, as a consumer and user, enjoys guarantees on the products that can be acquired through this Website, in the terms legally established for each type of product, Tubosdebaja being responsible, therefore, for the lack of conformity of the same that manifests itself within a period of three years from the delivery of the product.

In this sense, it is understood that the products are in conformity with the contract provided that: they conform to the description made by Tubosdebaja and possess the qualities presented therein; they are fit for the uses to which products of the same type are ordinarily intended; and they present the habitual quality and performance of a product of the same type and which are fundamentally expected from it. When this is not the case regarding the products delivered to the User, the latter must proceed as indicated in the section Return of defective products or shipping error. However, some of the products marketed on the Website could present non-homogeneous characteristics provided that these derive from the type of material with which they have been manufactured, and which will therefore form part of the individual appearance of the product, and will not be a defect.

On the other hand, it could be the case that the User acquires a product on the Website of a brand or manufactured by a third party. In this case, and the User considering that it is a defective product, they also have the possibility of contacting the brand or manufacturer responsible for the product to find out how to exercise their legal guarantee right directly against them during the three years following the delivery of said products. To do this, the User must have kept all information in relation to the guarantee of the products.

  1. EXONERATION OF LIABILITY

Unless legally provided otherwise, no liability will be accepted for the following losses, regardless of their origin:

  • any losses that were not attributable to any breach on its part;
  • business losses (including loss of profits, income, contracts, anticipated savings, data, loss of goodwill or unnecessary expenses incurred);
  • or any other indirect loss that was not reasonably foreseeable by both parties at the time the contract for the sale of the products was formalised between both parties.

Likewise, liability is also limited in the following cases:

  • it applies all measures concerning providing a faithful display of the product on the Website; however, it is not responsible for the minimal differences or inaccuracies that may exist due to a lack of screen resolution, or problems with the browser used or others of this nature.
  • it will act with maximum diligence for the purpose of making available to the company in charge of transporting the product object of the purchase order. However, it is not responsible for damages arising from a malfunction of transport, especially for reasons such as strikes, road delays, and in general any others typical of the sector, which lead to delays, losses or theft of the product.
  • Technical failures that, due to accidental or other causes, prevent a normal functioning of the service through the internet. Lack of availability of the Website for maintenance or other reasons, which prevents the service from being available. Tubosdebaja puts all means at its disposal to carry out the purchase, payment and shipping/delivery process of the products; nevertheless, it is exempt from liability for causes not attributable to it, accidental cases or force majeure.
  • it shall not be held responsible for the misuse and/or wear and tear of products that have been used by the User. At the same time, it will not be held responsible for an erroneous return made by the User. It is the User's responsibility to return the correct product.
  • In general, it will not be responsible for any non-compliance or delay in compliance with any of the obligations assumed, when the same is due to events beyond its reasonable control, i.e., due to force majeure, and this may include, by way of example but not limited to:
    • Strikes, lockouts or other industrial action.
    • Civil commotion, riot, invasion, terrorist threat or attack, war (whether declared or not) or threat or preparation for war.
    • Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster.
    • Inability to use trains, ships, aircraft, motor transport or other means of transport, whether public or private.
    • Inability to use public or private telecommunications systems.
    • Acts, decrees, legislation, regulations or restrictions of any government or public authority.

Strikes, lockouts or other protest measures. Civil commotion, riot, invasion, terrorist threat or attack, war (declared or not) or threat or preparations for war. Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster. Impossibility of using trains, ships, aircraft, motor transport or other means of transport, public or private. Impossibility of using public or private telecommunications systems. Acts, decrees, legislation, regulations or restrictions of any government or public authority. In this way, the obligations shall be suspended during the period in which the cause of force majeure continues, and there will be an extension in the period to fulfil them for a period of time equal to the duration of the cause of force majeure. Tubosdebaja will use all reasonable means to find a solution that allows it to comply with its obligations despite the cause of force majeure.

VILATRENZ 2000 S.L. supplies technical components whose installation and final use are the exclusive responsibility of the User. The company is not responsible for damages derived from an incorrect choice of material for a specific fluid/gas, nor for failures caused by an assembly that does not follow the technical standards of the sector (especially in fuel hoses or pressure systems).

  1. WRITTEN COMMUNICATIONS AND NOTIFICATIONS

Through the use of this Website, the User accepts that the majority of communications with Tubosdebaja will be electronic (email or notices published on the Website).

For contractual purposes, the User consents to using this electronic means of communication and acknowledges that all contracts, notifications, information and other communications sent electronically comply with the legal requirements of being in writing. This condition will not affect the rights recognised by law to the User.

The User may send notifications and/or communicate with Tubosdebaja through the contact details provided in these Conditions and, where appropriate, through the contact spaces of the Website.

Likewise, unless otherwise stipulated, the User may be contacted and/or notified at their email or at the postal address provided.

  1. WAIVER

The fact that VILATRENZ 2000 S.L. does not require strict compliance by the User with any of their obligations at a given time, or does not exercise a specific right or legal action, shall not imply a waiver of said rights or actions, nor shall it exonerate the User from compliance with their obligations in the future.

No waiver of these Conditions or the rights derived from a contract shall take effect unless it is expressly established, formalised and communicated to the User in writing.

  1. SEVERABILITY

If any of these Conditions were declared null and void by a final resolution issued by a competent authority, the remaining clauses shall remain in force, without being affected by said declaration of nullity.

  1. ENTIRE AGREEMENT

These Conditions and any document expressly referred to herein constitute the entire agreement existing between the User and Tubosdebaja in relation to the object of sale and replace any other previous pact, agreement or promise agreed verbally or in writing by the same parties.

The User and Tubosdebaja acknowledge having consented to the conclusion of a contract without having relied on any statement or promise made by the other party, except for what is expressly mentioned in these Conditions.

  1. DATA PROTECTION

The information or personal data that the User provides to Tubosdebaja in the course of a transaction on the Website will be processed in accordance with the provisions of the Privacy or data protection Policy (contained, where appropriate, in the Legal Notice and General Conditions of Use). By accessing, browsing and/or using the Website, the User consents to the processing of such information and data and declares that all the information or data they provide are truthful.

  1. APPLICABLE LEGISLATION AND JURISDICTION

Access, browsing and/or use of this Website and the contracts for the purchase of products through it shall be governed by Spanish legislation.

Any controversy, problem or disagreement arising from or related to access, browsing and/or use of the Website, or with the interpretation and execution of these Conditions, or with the sales contracts between Tubosdebaja and the User, shall be submitted to the non-exclusive jurisdiction of the Spanish courts and tribunals.

Furthermore, should a dispute arise from the conclusion of this purchase contract between Tubosdebaja and the User, the User as a consumer may request an out-of-court settlement of disputes, in accordance with Regulation (EU) 524/2013 of the European Parliament and of the Council, of 21 May 2013, on online dispute resolution for consumer disputes and amending Regulation (EC) 2006/2004 and Directive 2009/22/EC.
